They were probably unaware of the change by Sky. If they were selling the box with no mention of pairing then it's not really their issue anyway.
That would be the key. The boxes can be legitimately sold as working Freesat boxes. Only if it was advertised as being able to be paired with a Sky viewing card (which seems unlikely) would there be any comeback on the seller.
