Since Apple unprecedentedly upgraded the baseline M3 air models from 8gb of ram to 16gb am I able to return my device for a new one?

Find out more@Daniel0 It would depend on how long you've had it, if it's less than 30 days then you can return it and place an order to see if the ones Sky stock have the upgraded memory(this will involve a new credit check and there is no guarantee the stock will include the upgrade).
If you've had it more than 30 days then you cannot return it.

Thanks for the info, it's been over 30 days, almost 3 months now, so I am out of luck.

Well, assuming it's on a 'swap' contract then you can...
However, the trade in value of the device will be significantly below the outstanding credit. (So it's likely to be prohibitively expensive to swap now, but that's up to the OP)
