Just wanted some advice on property damage, id be grateful hear from others baout the installation contract as so far M Group are stating this allows them to come back to my property to complete further works. I had my fibre installed on 8th April and during the install there was blown brickwork that the installer did not let me know about and he told his manager I was happy with the work and was awre off it, anyway since then ive filled a claim with Openreach whom have passed it on to M Group, an appointemnet was made for last Tuesday where we could go through options, however they failed to attend. The next day I came home from work and was shocked to find out that they have attended my home without my permission and done further damage by installting an unsightly plastic cover on where the cable enters. I have further complained about this and the fact the engineer failed to attend the original appointment nor get in contact and attend on Wednesday without my permission. I filled a claim and complaint for trespasss to property however, they are trying to get out of it and deny it by saying taht the ocntarct allows them a re visit, can anyone confirm if this is true ? as when I signed up to full fibre I was told that the engineer would attend when someone was at hoem and permission would be sought first.

thank you @SpaceSparkie , it is a shame people feel the need to provide rude comments when they cannot accept something, but I suppose we can never please everyone, im in this forum to help otehrs and get help myself. @Chrisee I thought i'd let you know there is an upate as you appeared confused that Sky were reasposnisble for claims as opposed to Opnereach. Sky confirmed teh contract does not allow them to do repair work without my permission, only appointments that I agree to. Openreach subcontractors M Group ahve accepted full laibility for the damage and have paid out as well as a further payment. Just for future reference I have included the email form M Group below. I would again like to point out that whilst you contact your ISP if theres a fault with your interent or wnat to upgarde connection, if Openreach damage your property then you can contact and make a claim with them directly, there is a claim form and process on their website.
I hope this helps others if they find themselves in a simialr situation.

@Tommy2 you need to raise you concerns with Sky take photographs and talk tomthem. It is their responsibility to talk to Openreach who work for them. Going direct to Openreach's sub- contractor is never recommended as it bypasses the necessary steps. If Sky attemptvtomfob you off tell them they sre legally resonsible.

Thank you I've already done this but Sky have directed me to Openreach for the claim as Openreach ask me to complete a claim form. All I wanted to know was does the contract allow them to attend again and make alterations to my property?

@Tommy2 go back to Sky. You have no contract with Openreach nor with M Group only with Sky. Given the repair was unsatisfactory raise a formal complaint with Sky. Sorry to be directional but if a subby has messed up twice why even spend a second giving them a third chance?

Thank you @Chrisee im fully aware of this but as mentioned I've been referred to Openreach as Sky advised as they are responsible anyway the subcontractors have accepted liability, however I was just simply asking if the contract allows subcontractors to visit again to make alterations as part of the fibre ?
I think I know what the answer is but any proof or validation would be much appreciated

@Chrisee @I'm not giving them a third chance I'm raising a claim/complaint. Just to be clear I have already spoken with Sky and it's now between me and Openreach as Sky said. The process is for the customer to raise a claim with Openreach if Openreach have caused damage, this has been confirmed by Sky and Openreach have claim damage forms on their website. I think there may be some confusion, I am simply asking if when you sign up to FTTP (full fibre) with Sky it allows Openreach to make further repairs/installation without your permission?

Yes I'm aware but as I've explained several times Sky have TOLD me to speak with Openreach as you can raise a claim with them as that is the procedure, Sky can remind them however they can not and will not get involved. I think there is some confusion as I'm simply asking if the fibre contract allows them to visit without permission.

@Tommy2 for the third time you have no contract with the installer and the terms of their contraxtvwith Openreach are between the two companies so your guess is as goid as mine. Openreach do undertake external work without an appointment on occasions. I spent 20 years running consumer advice centres so do know what I am talking about.

@Chrisee is appreciate you've said it 3 times and I appreciate you may have your own view, you are correct that the broadband contract is with Sky so if there's a loss of service e.t.c then I would contact Sky and that's the process however, here it is appropriate to contact Openreach and you are giving advice which is factually incorrect as you state Openreach aren't responsible for the claims, if this is true then I would NOT have been directed to Openreach claims department.
again I'm simply asking if the fibre contract allows them to make alterations after the install, this is the contract with Sky.

@Chrisee Again I appreciate you have you own view and that's fine, however there is no need to be rude. I do have some experience in Conumer in law and am already aware that if there is property damage from Openreach then it is openreach you liase with, this is what Sky ofically confirmed and this is the reason why there are claims forms on thge Openreach website, anyway more to the point in question I was asking about the Sky contract not just Openreach one, I.e when you sign up to Sky FTTP does it allow Openreach to make alterations without your permission? - this is all I wanted to know, so the point you are raising about only delaing with Sky is irrelevant as Openreach subcontactors are already delaing with them claim and have admitted laibility for the initial damage but no the trepass to property by turning up again without my permission.

@Sharcuk I can't see the contract that I signed with Sky unfortunately and it's not clear online, part of research is through here actually for example someone might respond and inform me that the FTTP installation contract does not give them permission to enter your property without your permission or someone else might respond stating that it does give them permission to re enter for a repair even if you're not in and for them to repair without your permission- I don't suspect that this is the case though, but I'm looking for help and advice on the matter.
