Mis selling

Preserved a new iPhone 16pro on 2 Sept, paid upfront cost and signed contract .I later discovered the phone is out of stock! It's now been over a week and still nobody at Sky can tell me when I can expect the phone , if at all. 
How can it be right you sell something that you don't have and take money upfront and sign a contract??? Despite calling Sky nobody can give a definitive answer.

It was announced yesterday that Apple are discontinuing the iPhone 16 Pro and 16 Pro Max which Sky probably didn't know when you ordered. Whether they'll get any more stock is another matter.

Apple's strategy has tended to only make the latest model available in the 'Pro' model.

 

It's possible you won't be able to get a 16 Pro.  You may have to cancel and re-order a 17 Pro.

I am just another Sky customer and my views are my own even if you don't like the answers

I have a signed contract with Sky to provide that phone so where does that leave me legally? Sky will try to wriggle out of any obligation with lies

They say 1-2 weeks but I have heard so many lies. On Monday I was told 24-48 hours! Sky will always lie

Sorry but that's not what I have found @Martdj  sky don't always lie. If they have said 1-2 weeks then have you waited for that 1-2 weeks ? You can also cancel the order and go elsewhere if other suppliers are able to provide the device for you at the same price ?

@Martdj Why on earth would you do business with a company that you state "always lie", that seems incredibly odd to me.

As for the phone being out of stock, that has been a tactic of Apple for many years  it's designed to push you towards buying the latest version by restricting stock availability or discontinuing the old version
