Wifi not at speed

We've just had an engineer out who has replaced the phone connection box and a few wires. He states we should have at least 40 megabytes, however, we're only receiving 4, why is this happening?

Does our router need changing?

Will we be compensated for the last 6 days we've missed out through internet disruption?
