There's no obligation for an ISP to provide the best possible speed to a particular address. The Government, through Ofcom, has chosen to set USO at 10/1 Mbs : everything past that is 'best effort' within commercially viable parameters.
Frankly no-one is now really interested in fixing longstanding issues with copper anyway: that's a 19th century technology best left behind.
