Imposition of early termination penalty

Why and how are Sky trying to impose an early termination penalty when they have agreed they can not achieve the contracted guranteed speed on my broadband? They carried out a 30 day check which showed they could not deliver the promissed guranteed speed and so I terminated. I have now had a notice to pay a significant early termination penalty.

I suspect you'd need to make it very clear that the 'termination' was under the terms of the Guaranteed Minimum Download Speed

 

Sky has to formally notify you that they can't meet this speed, and so offer the option to leave without penalty: you shouldn't cancel before this has happened

 

If they did notify you, then you'll need to phone in and dispute the penalty (which shouldn't be a problem).
