Well, the legislation which underpins the existence of Ofcom long pre-dates internet speed fast enough for streaming and before on-demand was a thing, so that's perhaps not surprising.  However I'd suggest legitimate companies still abide by most of its regulation, although it's unclear if they have to do so.
