Driver refusing to make delivery.

Hi there,

 

I am just wondering if anyone has had a similar issue to the one I am having / has any advice. 

My sky glass air delivery was due on the 14th of July, when the drivers arrived (AIT delivery, formerly panther) they refused to make the drop. Stating that they wouldn't stop in the road to make it as there was no parking spaces. 

I live on a residential street, it isn't a main road. The parking spaces were full as everyone was home from work however, upon checking the uk road laws it seems that delivery drivers may stop in a road as long as they do not linger prior or following delivery. 
All they needed to do was take it out the van as myself and my partner would be able to take it into the property. 

I argued this with the delivery dispatch that called me as the drivers would not answer my calls back, but I was told that it was point blank illegal and nothing could be done. 

Delivery is rebooked for tomorrow. But sky have told me that is the same issue occurs then the whole order will be cancelled and I will need to await a refund as I've paid outright. 

Does anyone have any advice on this, sky have agreed for a contract to go to this address and accepted contract for the goods to be delivered here but the drivers are refusing. 

also to note, thought the drivers wouldn't stop to give me the TV, they did stop to take a 5 minute phone call in the middle of the road.

An update for anyone who is nosey

 

I got the tv!!! Wasn't in the time slot I paid for but the delivery boys this time were absolutely lovely. Stopped in the road with absolutely no complaints and brought it upstairs for me. 

lisa from the expert team has also been an absolute joy in helping me with this and has gone above and beyond with it and helping me raise a complaint. 

now I'm away for a cup of tea and some tv.

@Hollly0154 I don't think it's a contractual issue. It's the delivery driver's responsibility to make sure they can deliver safely and unfortunately it looks like thier asessment was that they couldn't do so on the first visit. Hopefully they'll be able to park safely and deliver successfully tomorrow.

Thanks for your reply! Yeah I guess I am just stuck between a rock and a hard place with this one. 
The street is a side street and runs through flats so it is used for parking rather than traffic really, unless you are a delivery driver. 
I've had couches and beds delivered fine and dandy but not much I can do if they refuse, even if they do stop in the middle of the road to take a phone call haha. 
it's a shame they are stating it is a legal issue though, when I've contacted the council now and they state that they are able to stop to deliver, but they aren't willing to accept it. 

I have had issues with panther / AIT previously so presumed an issue would arrise.

 

oh well back to drawing board for a new tv if this doesn't work out!

There are, unfortunately some companies who like to say 'it's a legal matter' to deter further debate or objection - even when it's not.......

Are you able to provide a different delivery address ? Maybe a relative or friend ?

 

could you park your own car in the street and then move it when the delivery driver arrives to give them space ?

Hi there! 

unfortunately I don't drive so I wouldn't be able to do so, however a space did become available when they were there and they refused to park. They stated the van had to be diagonal but as to why, I am not sure. If that is the case they would need about 3 car parking spaces on the street in a row which is virtually impossible. 

Called sky yesterday and I was told that it can't go to another address under any condition. 

I'm hoping it's a different team tomorrow and that the last ones were just being difficult for no reason. 

massive anxiety for tomorrow as I will be without a tv, which is clearly fixable by going with another company, but if I want streaming on a box it will require another credit check if order is cancelled. 
paid for a morning slot (35 pounds) which they state won't be refunded if the delivery doesn't prove to be successful, but it was my best shot at getting a space.

Update - paid 35 pounds for a morning slot 7-10 am. Just been told it's getting delivered between half 3 and half 5 in the evening.

If I were you I'd cancel the whole thing & insist on a refund. Service like that (or rather lack of) just isn't good enough. Spend your money elsewhere.

Thinking of doing exactly that. There has been even more issues believe it or not such as sky agents being rude, not processing refunds for another order and inputting my address wrong on a previous order. 

total shambles. Such a shame as my family have been a sky customer for so long. Not meant to be. Especially for that price.
