i dont care if the programes i am watching are old ,i dont live stream or record,so why cant sky put in a system that prevents me from doing this if i ask them to

You do not need a TV licence for any SKY TV box (or from  other providers).

It is your specific use that determines whether you need to have a TV licence or not

Why should Sky to to the expense when it's not their issue? 

Surely it should be left to people to decide what they watch & how.

If you own a smartphone, computer, tablet, console or reasonably sophisticated fridge, you could also be watching live television on those.

It's use which is licenced, not technology.

TVLA has to prove a resident was consuming content in a way which requires the property to be covered by a licence: the presence of potentially usable hardware is not enough.
