Being charged for 2 phones only got one

If you kept your old phone and chose not to swap it then you're still paying for it on the remainder of it's origianl contract, for example if you had it on Swap24 that is a 36 month contract with an option to swap at month 24,  with the value of your old handset paying off the remainder of that contract.

No.  But you would for any dataplan unless you cancelled that.
