So contract is up 16th September and need to give minimum 31 days notice to cancel.
called today and am told that no I can't cancel as it also needs to be less than 40 days. I have no correspondence that this was ever the case. Does anyone have similar experience

You don't say what services but the Q contract says, "...you may end a TV subscription service by giving us 31 days’ notice to expire no earlier than when the minimum term for that TV subscription service has ended."

40 days seems reasonable...

Sorry. Its Sky +. I am 50 days out currently but seemingly I need to be 40 days out but no more than 31. I also used the text service and they are saying I cant cancel until 10th of august and then later anytime in august. Surely if i want to cancel now, they just charge me until my contract is up?

The issue is that I have taken the time to cancel now as I had remembered to do so. Like I am not trying to get out of paying the full 12 months. I am just giving them notice of my intention to cancel. The hassle of having to go through the whole rigmarole of getting in contact with them again is a pain. There is no other organisation that is this hard to deal with. Like even finding a phone number is an ordeal.

The below is the line on my contract.

After your cooling off period, to end your TV contract you'll need to give us 31 days' notice which cannot end before your new minimum term finishes. Early termination charges are payable if, during your new minimum terms (where applicable), your Talk/Line Rental or Broadband contracts end (other than where you have a right to end them without charge under the terms and conditions) or we end your TV contract because you have breached your terms and conditions.

Nothing I can add - if they are holding you to the terms of the contract then you'll have to call back when you can cancel.

ETC's would be payable if they did agree to early cancellation but for the sake of 10 days...

I know what your are saying but the contract does not say what you said. And I am willing to pay early termination fee if required. Honestly they were the most unhelpful and arrogant people ive encountered in customer service. If they had politely said that unfortunately these are in the t&c s i received id say fair enough. No they wouldnt even listen

Again, I have read this and there is nothing written on it to state they could not start the cancellation process today so that it ends when minimum term expires. In fact I have given them the notice they are looking for. 'A minimum 31 days'

Even if i was wrong they could still cancel at my request and charge an early termination fee but again they did not do this or state this as an option

There seems to be some confusion over what @Skytvcustomer wants to do, which is simply to set a cancellation date on the final day of the contract. They absolutely can do that and in fact could have set a date 24 months down the line on the day they signed up. If Skys software can't handle that then that's not the customers problem.

I suspect it may be that the agents they've been chatting to either don't know how to do that or are simply trying to pass the cancellation stat on to someone else.
