HMRC only requires VAT invoices for business to business transactions. As @Mark39 indicates, Sky Mobile is not a business telecoms provider and so doesn't separate out VAT even if the subscriber is personally VAT registered.

I have the same issue, I have just phoned and spoken to SKY and they are unwilling and unable to provide a VAT breakdown on either billing or on an historical basis.

They confirmed that VAT is part of the bill and I am being charged VAT but they would not provide the details. I pressed the point that if I am being billed for a service and for a tax then they should be confirming to me what that breakdown is

If you need VAT invoices then SKY is not the provider for you despite being required to provide one if asked for !!!

HMRC Guidance note 700 states

16.6.2 Retailers’ VAT invoices

If you make retail sales, you should give your customer a VAT invoice if asked for one. You may be liable to a financial penalty if you do not issue a VAT invoice when asked to do so by a taxable person.

A taxable person is an individual, firm, company and so on who is, or is required to be, registered for VAT (as defined in the same document)

In this context the Sky Mobile customer is not a taxable person because the contract is not for a business communication service .

That a phone and/or SIM acquired through Sky Mobile might be used for business purposes, or the user is themselves personally VAT registered, is irrelevant: hardware and connectivity is not provided on that basis.

As noted elsewhere, it's reasonably safe to assume that a small army of tax lawyers has perused Sky operations in this area over many years and is prepared to defend their position to HMRC and anyone else.

Business use is excluded in Sky's terms and conditions. They don't provide services for business use unless you have, and pay for Sky for Business. I imagine Sky for Business provide VAT invoices.

This is a huge issue for both business and non business. Sky is VAT regitered and sells a product with VAT included. When taken the contract were you told that you will not recieve a invoice showing VAT. ' No' When you were sold or purchased the contract were you told that the phone can only be use as part of non business call? No. You could argue that you have been mis-sold. However, When you sell goods or services, you must do the following work out the VAT-inclusive price using the correct VAT rateshow the VAT information on your invoice - invoices must include your VAT number and display the VAT separatelyshow the transaction in your VAT account - a summary of your VATrecord the amount on your VAT return. This is from the HMRC website. Furthermore is sky are claim VAT after sales you are allow to request your data . The GDPR gives you the legal right to a Subject Access Request (SAR), allowing you to ask organizations for a copy of your personal data and to understand how and why it's being used. You can make a request in writing or verbally, and the organization must respond without undue delay and at the latest within one month, although this can be extended for complex or numerous requests. Sky Mobile is a service for the personal use of UK consumers only- this term doesn't exclude from UK tax guidance

service charging VAT is still liable to UK tax HMRC rules. VAT being charged at 0% to 20% must be shown on the invoice to the individual or business

@PKLlewellyn Sky are not legally obliged to provide VAT receipts to residential/domestic customsers, they are only legally obliged to do so to business customers who are also VAT registered.

VATREC4010 - VAT invoices: requirement to provide invoices: The legal obligation to provide a VAT invoice

VAT Act 1994, schedule 11 paragraph 2A allows for the making of regulations which may require invoices (to be referred to as “VAT invoices”) containing specified particulars to be provided by taxable persons supplying goods or services to other taxable persons. Such regulations are in VAT Regulations 1995, Regulations 13-20
