Hi, im wantimg to return my handsetive had for 1 week as its too big for me and want something smaller, i rang them and they said they would send a returns package out to me. Which i havnt recieved yet. Im having to pay for the handset as its on my bill. Will they cancel the agreement and contract when they get the ohone back and refund me my payment i have paid.

Yes the agreement will be cancelled and should have been already I would have thought and any payments you have made should be returned within a few weeks once the device has been returned.
