I am looking to upgrade my phone as I'm now out of contract. Can I just stay on the sim deal that I'm on ?

Yes so just order the new phone and if it wants you to also order a new sim then pick one with the cheapest price and when the sim arrives do not activate it so it will be cancelled.

Yes. Simply move the SIM from old to new phone.

If you can't checkout without a new dataplan then simply do not activate it. (You won't be charged)
