ex partner took the phone

My ex partner refused to hand me the phone back after only having 2 days and I would of been able to send it back. Now it's in the hands of police but I'm left paying for it. Any help would be appreciated

You will have to wait for the police to sort this out for you because if you are the account holder then you will be billed for it until it has been received into stock when it has been returned.

The police will have it for at least 6 months while they carry out investigations, then if anything is found on it from my ex using it then it will be destroyed. So basically I'm left paying fro something I've never used?

If it is going to be destroyed then as long as you have proof that this is being done then you can approach Sky with this or you can try speaking to them now to see what they say.

I'm thinking we aren't getting the full story here. There's no reason that I can think of that would suggest why the police would destroy the mobile at the conclusion of their investigation. If you can prove to them that you're the Sky mobile account holder they should return it to you.

They are doing ongoing investigations which will take at least 6 months,I've explained I'm in a contract but they've stated there's nothing they can do

Because of the type of evidence that's possibly on it. The police said they destroy all phones etc at the end of an investigation

I don't believe that's correct. My son's phone was confiscated for an investigation and was returned several months later. Although may depend on the Force.

Obviously I don't know or want to know what content might be on it which may be a deciding factor but my local force do not destroy all phones at the end of the investigation.

@Daniel0210 and @PandJ2020 If during a police investigation evidence is found on a device(texts,videos,photos,search history) that leads to a person being charged then they will request a destruction order be made by the court.

If no evidence is found the owner of the device can request it is returned.

Yes, you are correct. That's a destruction ordered by a court. The OP hasn't indicated the investigation has reached that stage yet so they will have to wait from the police investigation to conclude. In general terms it's not the decision of the police to destroy them.
